Proving Liability in a Missouri Personal Injury Case

Q: What must be proven to establish liability in Missouri?

A: To hold someone liable, Missouri law generally requires proof of four elements:

  1. Duty of care – The person had a legal obligation to act reasonably (for example, driving safely or maintaining safe property).

  2. Breach of duty – They failed to meet that obligation.

  3. Causation – Their actions (or failure to act) caused your injury.

  4. Damages – You suffered actual harm, such as medical expenses or lost income.

If any one of these elements is missing, liability may be disputed.
